Maybe, it was planned to be the track number 12 everywhere and then they changed theirs minds.

Japanese albums often include an extra track or remix. The Japanese version of Fundamentalism had an extra remix that wasn't on other versions. I think it is because imported albums are usually cheaper than the local release in Japan so record companies jazz the Japanese edition up a bit.

I would imagine We're All Criminals Now was considered for 12th track but not finished in time.

Never say never. For example, it's the first time they include such a long track (Legacy - 6:34) in an album (apart from Introspective's ones).
