If we can't discuss file sharing, in my opinion we shouldn't be able to discuss unofficial youtube uploads. I can upload anything and everything to Youtube, it's the same as uploading to a file sharing site. It doesn't mean it's clear for copyright.

If it's uploaded to Youtube then it is public, that's the difference. It's as if I wouldn't be able to discuss what I just saw on my morning walk through the city or neighbourhood. I might have seen unlawful things or copyright breaches there as well. And the programme was broadcast on public tv (non-commercial) to tens of millions of people. Some of us were unfortunate enough to be on the wrong side of a border and not able to see it.
